SMS Terms and Conditions

 

Your use of the SMS authentication and alert service ("service") constitutes your agreement to the Terms and Conditions outlined herein. The service as well as the content and materials received through the service are proprietary to us and our licensors, and is for your personal, non-commercial use only. You shall not damage, impair, interfere with, or disrupt the service or its functionality. We reserve the right to alter charges and/or these terms and conditions from time to time. We may suspend or terminate the service to you if we believe you are in breach of our terms and conditions. Your service is also subject to termination in the event your wireless service terminates or lapses. We may discontinue the service at any time. This service is only available in the United States.

Applicable Charges
Your wireless carrier’s standard message rates apply to SMS services. You represent that you are the owner, or authorized user of the wireless device you use to receive the service, and that you are authorized to approve the applicable charges.  Southern First Bank does not charge for any content, questions, or general information requests; however, downloadable content may incur additional charges from your wireless carrier. Please contact your wireless carrier for information about your messaging plan. Your carrier may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your wireless carrier.

Opting Out of the Service
You are allowed to opt out of the SMS service at any time. If you receive a message from us unexpectedly or want to discontinue the service, you can text the word STOP as a reply to an alert message or text it directly to 20736.

Privacy & Information Sharing
The data obtained from you in connection with this service may include your wireless phone number, your carrier’s name, and the date, time and content of your messages, and other information that you may provide. We may use this information to contact you and provide the services you request from us. We will only use the information you provide to transmit SMS messages.

Southern First Bank will maintain reasonable safeguards to protect the information from unauthorized disclosure or use; however, we reserve the right to use and disclose this information to perform analytics to improve the service and as otherwise permitted by law. This includes compliance with court orders or lawful instructions from a government agency, to protect the personal safety of subscribers or the public, to defend claims, or as otherwise authorized by you.

As alerts delivered via SMS are not encrypted, we will never include your full account number. You acknowledge and agree that alerts may not be encrypted and may include your name and some information about your account(s) and anyone with access to your alerts will be able to view the content of these messages.

Your wireless carrier may collect data from your SMS usage and their practices are governed by their own privacy and information sharing policies.

Alert Format
We may provide alerts through one or more channels: (a) a wireless device by text message; (b) a wireless device by push notification, (c) an email account by an e-mail message; or (d) through your Southern First online banking message inbox by an e-mail message.

Alert Content
An alert does not constitute a bank record for the deposit account to which it pertains. You understand that balances provided may not include recent or pending transactions that have not yet posted to your account and that other restrictions may apply, as outlined in your deposit account agreement.

You agree that Southern First Bank is not liable for any errors in alert information, or for any action you may or may not take in reliance on the information or service.

Limitation of Liability
We strive to provide alerts in a timely manner with accurate information. However, you acknowledge and agree that your receipt of any alerts may be delayed or prevented by factor(s) affecting your wireless service provider, internet service provider(s) and other factors outside of Southern First Bank’s control.  In no event shall Southern First Bank be liable for any claim arising from delayed, misdirected, or failed delivery of any information sent through the service.

You agree to indemnify, defend, and hold us harmless from any third-party claims, liability, damages, or costs arising from (1) your use of the SMS service, and (2) the provision of a phone number that is not your own.

You agree to notify us immediately of any changes to your registered wireless device. In case of unauthorized access to your wireless device or service, you agree to cancel enrollment associated with the device immediately.
